Claire E. Parsons, an Associate in the Government Practice, Civil Litigation, and School Law practice groups, published an article in August in Common Defense, a statewide publication of the Kentucky Defense Council, Inc. entitled Discovering Coverdell: Maximizing Statutory Immunity for School Officials.  The article explained the elements of the Paul C. Coverdell Teacher Liability Protection Act of 2001, which provides broad-based immunity for teachers sued on state law tort theories.  Although the defense has been underutilized in the first decade after its passage, the article explains how Coverdell Immunity is now emerging as a powerful defense for school officials which may, in some cases, exceed the immunity defenses already available under state law.  You can view a full version of the article here.
