ASWD Partner Lee Metzger has secured a huge victory in federal criminal case no. 2:17-CR-10, as the Indictment against his client has been dismissed. The client had been charged in the Eastern District of Kentucky with conspiracy to distribute carfentanil and a related overdose death. If convicted, the potentially-applicable mandatory minimum penalty was life imprisonment. Obviously, the stakes were huge. Mr. Metzger vigorously defended the case, which the federal judiciary quickly deemed a “complex” matter. His winning strategy and robust defense theories ultimately led the Government to concede that it lacked sufficient evidence to proceed to trial, resulting in the dismissal of the Indictment.
“This is a good day,” Mr. Metzger stated upon learning that the Indictment had been dismissed. “When a client has been wrongfully accused, the only way to win is to fight. And we gave them one heck of a fight here. I’m not afraid to go toe-to-toe with a federal prosecutor. That’s my job: to stand tall.
